Since the majority of punishments in our criminal law are Ta`zir (discretionary), the importance and necessity of explaining these criteria more are felt. It seems, these shortcomings result from uncertainty about the necessity or the possibility of extracting such criteria from Islamic sources. This paper tries to prove that the extraction of such criteria from Islamic sources is both necessary and possible; because by scrutiny of criteria for grading the values that are supported by Islamic criminal system, and also by resorting to the juridical rule of relation between reasonable sentence and Islamic for emerging crimes, or by paying attention to the rule of Aham-mo Mohem ("What is more important is preferred on what's important" about self-defense and conflicting duties and rights), we can obtain the main criteria and principles for classification of crimes یکی از کاستی‌های حقوق کیفری کشور ما عدم تبیین کامل ملاک‌های اسلامی طبقه‌‌بندی جرائم است که باعث مشکلاتی از قبیل عدم تناسب برخی مجازات‌های تعزیری با جرائم، ناهماهنگی در قوانین کیفری و صدور برخی احکام متعارض در دادگاه‌ها شده است. از آنجا که اکثر قریب به اتفاق مجازات‌ها در حقوق کیفری ما تعزیری است که میزان آن‌ها در شرع معین نشده است، اهمیت و ضرورت تبیین این ملاک‌ها بیشتر احساس می‌شود. به نظر می‌رسد این کاستی ناشی از تردید در ضرورت یا امکان استخراج چنین معیارهایی از منابع اسلامی است. این نوشتار، سعی کرده است ثابت کند، استخراج این ملاک‌ها از متون اسلامی ممکن و ضروری است. چه اینکه با امعان نظر در ملاک‌های رتبه‌بندی مصالح و ارزش‌های مورد حمایت نظام کیفری اسلام و با تمسک به قاعدة ملازمة عقل و شرع در جرائم مستحدثه، و با توجه به معیارهای تشخیص اهم و مهم در زمینة دفاع مشروع و در زمینة تزاحم تکالیف و حقوق، می‌توان به مبانی و معیارهای اصلی طبقه‌بندی جرائم در اسلام دست یافت. <br /><strong> </strong> https://jclp.ut.ac.ir/article_59134_6859ad3d2656dc940a09f13825de1902.pdf
